Introduction

These terms and conditions (“Terms and Conditions”) are between Aayush Wellness Limited, having its corporate office at Floor No 2, B Wing, Unit No 310, Royal Palms, Orchard Road Mall, Aarey Colony, Mumbai, Maharashtra - 400065, incorporated under the laws of India, and you (“you” or “your” or “User(s)”) and they shall govern your use of the Aayush Health Platform.

Your access to the Platform is subject to your acceptance of the Platform Terms and such acceptance forms a legally binding agreement between you and Aayush Wellness Limited (“Agreement”).

Platform Terms

The following terms and conditions apply to your use of the Aayush Health Telemedicine Platform and its associated services:

• For Health Care Service Providers: Principal terms of engagement including the specifications, fees, and deliverables.
• For Patient-Users: Terms and conditions governing services provided by Health Care Service Providers.
• Privacy Policy: Included as part of the overall terms.

Eligibility Requirements

To access and use the Platform, you must meet the eligibility requirements, including age requirements:

• If you are a resident of India, you must be at least 18 years of age.
• If you are a resident outside India, you must ensure that you have reached the legal age to enter into contracts in your jurisdiction.

Platform Services

The Platform is an online service that connects Health Care Service Providers and patient-users. Aayush Wellness Limited operates the platform but does not directly provide health services.

Payment & Refund

Payments for services are processed through the available payment gateway. Refunds are only available under specific cancellation terms:

• Full refund for cancellations made at least 12 hours before the consultation.
• 50% refund for cancellations made between 1 and 12 hours before the consultation.
• No refund for no-shows or cancellations made within 1 hour before the consultation.

Confidentiality

You are responsible for maintaining the confidentiality of your account and password. You must ensure that your personal information is kept secure and up-to-date. Any unauthorized access to your account should be immediately reported to us.

Limitations of Liability

Aayush Wellness Limited is not liable for any damages, losses, or injuries arising from the use of the platform, including any failure, technical issues, or unauthorized access to your account.

Indemnity

You agree to defend, indemnify, and hold harmless Aayush Wellness Limited from any claims, damages, or losses arising from your use of the platform or your violation of these terms.

Governing Law

The Agreement shall be governed by the laws of India, and any disputes will be resolved through arbitration as per the Arbitration and Conciliation Act, 1996.
